These terms apply when you browse the public site, create an account, upload project material, generate outputs, or use the platform’s scene-aware memorial design features.
You are responsible for the accuracy, legality, and permissions associated with any content or assets you submit.
AI-assisted outputs may require human review before they are suitable for client presentation, approval, fabrication, or site use.
1. Acceptance of terms
By accessing or using MemoriaMind, you agree to these Terms of Service and any additional policies referenced here. If you do not agree, do not use the service.
2. The services
MemoriaMind may include tools and workflows for:
- AI-assisted memorial concept generation and editing.
- Interactive 3D object review and scene-aware staging.
- Uploading, storing, organizing, and exporting project assets.
- Producing proposal-ready captures, files, and presentation surfaces.
- Managing subscriptions, collaboration, and customer support interactions.
We may change, suspend, or discontinue features at any time.
3. Accounts and access
If you create an account, you must provide accurate information, keep credentials secure, and notify us if you suspect unauthorized access. You are responsible for activity that occurs through your account.
4. User content and permissions
You retain rights in content you submit to the extent allowed by law and your agreements with third parties. You represent that you have the rights and permissions needed to upload, process, and use that content with the service.
To operate the service, you grant MemoriaMind a limited license to host, store, reproduce, process, transmit, and display submitted content as needed to provide and improve the platform.
5. Acceptable use
You may not use the service to:
- Violate law or infringe the rights of others.
- Upload malicious code, abuse the platform, or interfere with its operation.
- Attempt to access unauthorized data, accounts, or systems.
- Misrepresent generated outputs as reviewed, approved, or fabrication-ready when they are not.
- Reverse engineer or misuse proprietary software, models, or infrastructure except as permitted by law.
Paid features, subscriptions, or plan access may be governed by separate pricing and billing terms presented at purchase.
The site, software, branding, and service materials remain the property of MemoriaMind or its licensors.
We may suspend or terminate access if use violates these terms, creates risk, or harms the service or others.
6. Disclaimers
The service is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted operation, error-free performance, or that any AI-assisted output will satisfy a particular design, regulatory, cultural, cemetery, or fabrication requirement without additional human review.
7. Limitation of liability
To the fullest extent permitted by law, MemoriaMind and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenues, goodwill, use, or data arising from or related to the service.
Where liability cannot be excluded, our aggregate liability will be limited to the amount you paid to us for the service giving rise to the claim during the 12 months before the event at issue.
8. Governing law
These terms are governed by the laws of the State of Minnesota, without regard to conflict of law principles, except where applicable law requires otherwise.
9. Changes to these terms
We may update these terms from time to time. Continued use of the service after updated terms take effect constitutes acceptance of the revised terms. The version above is effective as of May 16, 2026.
